COPYRIGHT INFRINGEMENT
The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted by Dental Learning infringe your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. The notice must include the following information as required by 17 USC. § 512(c)(3)(A): (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed (or if multiple copyrighted works located on the site are covered by a single notification, a representative list of such works); (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Dental Learning to locate the material on the site; (d) the name, address, telephone number, and email address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. If you believe in good faith that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send Dental Learning a counter-notice. Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA; see http://www.loc.gov/copyright/ for details. Notices and counter-notices with respect to the Site should be sent in writing to Dental Learning, 500 Craig Rd, Suite 101, Manalapan, NJ, 07726, USA (copyright @ dentallearning.net) (remove spaces when sending email). We suggest that you consult your legal advisor before filing a notice or counter-notice. Also, be aware that there are penalties for false claims under the DMCA.
Provision of the Communication Decency Act
Dental Learning and Henry Schein Inc. facilitate the upload of third party content and hosts such content on vivalearning.com and its affiliate sites. Dental Learning is protected under Section 230 of the Communications Decency Act. Section 230 states that "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider" (47 U.S.C. § 230). In other words, online intermediaries, such as Dental Learning, that host or republish the third party speech of others do not have the liability for such material and do not have the liability of the author of such material and are protected against a range of laws that might otherwise be used to hold them legally responsible for what others say and do. The protected intermediaries include not only regular Internet Service Providers (ISPs), but also a range of "interactive computer service providers," including basically any online service that allows third parties to have material posted to its site. Other than copyright infringement, if you feel that any third party material hosted on the Dental Learning site is violative of your rights, Dental Learning does not promise to remove such material but may consider the removal upon request. Dental Learning shall be the sole determinant of what constitutes material violative of third party rights in this regard.
TRADEMARKS
Dental Learning's trademarks and trade dress may not be used in connection with any product or service that is not Dental Learning's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Dental Learning. All other trademarks not owned by Dental Learning or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Dental Learning or its subsidiaries. If you feel a third party hosted on the Dental Learning site has violated your Trademark, please contact Dental Learning with a full description of the violation and proof of your ownership of the trademark at issue.

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Dental Learning reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant Dental Learning and its associates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
